El 20 de febrero de 2026, el Primer Tribunal Colegiado de Oaxaca reconoció oficialmente la falsedad de los testimonios contra Miguel y lo absolvió de todos los cargos.
Esta sentencia debió poner fin a la persecución política, sin embargo, el 12 de junio de 2026, fuimos notificadxs de que el caso de Miguel regresa a la Suprema Corte, pues se admitió un recurso de revisión presentado por la parte acusadora, la diputada Elisa Zepeda, contra la sentencia de plena libertad, que ahora se encuentra “suspendida” hasta que la Corte decida. Se reabre así el caso de Miguel y se sigue dando continuidad a la persecución estatal en su contra. Se espera que la nueva sentencia de la Suprema Corte se dicte en algún momento de 2027. Los próximos meses son clave para exigir a la Corte poner fin a esta persecución.

Why Does the Political Persecution Against Miguel Peralta Continue?
On February 20, 2026, the First Collegiate Court of Oaxaca officially recognized the falsity of the testimonies against Miguel, thereby acquitting him of all charges.
That ruling should have put an end to the political persecution against him. However, on June 12, 2026, we were notified that the case of Miguel has returned to the Supreme Court, as the court accepted a motion for review filed by the accusing party—the State Congresswoman Elisa Zepeda—against the ruling granting him absolute freedom. That ruling has now been “suspended” until the Supreme Court dictates a new ruling. Miguel’s case has thus been reopened, and the State persecution against him continues. The new ruling from the Supreme Court is expected sometime in 2027. The coming months are crucial to demand the court put an end once and for all to the persecution.
